This Privacy Policy explains how we collect, use, disclose, retain, and protect personal information when you visit LatheCutVinylRecords.com, place an order, submit production materials, communicate with us, or otherwise use our website, products, and services.

Our online store is hosted by Shopify, which provides the ecommerce platform that allows us to offer our products and services.

1. Information We Collect

  • Information collected through cookies and similar technologies

Payment-card information may be processed by Shopify, Shopify Payments, payment networks, banks, or other payment providers. We do not need to directly possess your complete payment-card number to process an order.

2. How We Use Information

We may use personal information to:

  • Process and fulfill orders
  • Manufacture custom products
  • Perform mastering, sequencing, audio, artwork, and other purchased services
  • Process payments
  • Provide customer service
  • Communicate regarding an order
  • Review submitted audio, artwork, PQ sheets, and production materials

3. Custom Order & Production Files

Customers may submit audio recordings, artwork, photographs, names, designs, logos, production instructions, PQ sheets, metadata, and other materials necessary to manufacture custom products or perform purchased services.

We use these materials as reasonably necessary to evaluate, prepare, master, sequence, manufacture, print, engrave, fulfill, document, and support the applicable order or service.

Lathe Cut Vinyl Records is not a permanent file-storage, archival, backup, or cloud-storage service.

Production files may be deleted after an order has been completed and transferred to the applicable carrier. We do not guarantee any minimum post-production retention period for customer audio, artwork, PQ sheets, production files, masters, metadata, or other submitted production materials unless expressly agreed otherwise in writing.

Customers are responsible for maintaining their own permanent copies and backups of all submitted audio, artwork, masters, PQ sheets, metadata, and other production materials.

A future reorder may require the customer to resubmit complete production materials even where Lathe Cut Vinyl Records previously manufactured or processed the project.

We are not obligated to reconstruct a previous project from incomplete records, emails, screenshots, previously manufactured records, or partial production files.

Deletion of production files does not necessarily require deletion of ordinary business records.

We may retain order information, invoices, communications, payment information, shipping information, transaction records, production notes, claim records, dispute records, fraud-prevention information, and other information for legitimate business, tax, accounting, legal, security, warranty, fraud-prevention, or dispute-resolution purposes as permitted or required by applicable law.

Customers should not submit sensitive personal information that is unnecessary for production.

4. Shopify & Service Providers

Our store is powered by Shopify.

Shopify may collect and process information relating to your use of our store in accordance with Shopify's own privacy practices and applicable law.

We may also provide information to service providers when reasonably necessary to operate our business, including:

  • Payment processors and financial institutions
  • Shipping and delivery carriers
  • Website and ecommerce providers
  • Cloud storage and technology providers
  • Email and communications providers
  • File-transfer and production-file providers
  • Fraud-prevention and security providers
  • Accounting, tax, legal, and professional service providers

These providers may process information as necessary to perform services for us or as otherwise permitted by their own legal obligations and privacy policies.

Shopify Network Intelligence

Shopify Network Intelligence is enabled for our store. Shopify may use information from your interactions with our store together with information from interactions with other merchants and Shopify to provide enhanced features, including personalization, advertising, and store improvements. These uses are subject to applicable consent and opt-out choices. See Shopify's Consumer Privacy Policy and Shopify's Privacy Portal for more information and additional choices.

Production-file uploads

We use Upload-Lift by Cloudlift to receive and associate uploaded production files with your cart or order. Processing may include uploaded audio, artwork, ZIP files, filenames, file links, and production information. File-upload and storage providers receive the information needed to perform that service. Uploading production files is separate from accepting optional analytics or advertising cookies.

5. Shipping Information

When an order requires shipping, we may provide your name, shipping address, contact information, and other information reasonably necessary for delivery to USPS, UPS, FedEx, a freight carrier, freight forwarder, insurer, or another applicable shipping or fulfillment provider.

Shipping providers process that information according to their own privacy practices.

Where a customer requests additional shipping insurance, declared-value coverage, freight forwarding, or another special shipping arrangement, information reasonably necessary to arrange or administer that service may be provided to the applicable carrier, insurer, coverage provider, freight forwarder, or service provider.

6. Payment Information

Payments may be processed through Shopify Payments or other payment providers available through our store.

Payment processors, banks, card networks, and other financial-service providers may independently collect and process information necessary to authorize, process, secure, and document transactions.

We do not sell complete payment-card numbers or use them for unrelated purposes.

7. Fraud Prevention, Claims & Payment Disputes

We may preserve, use, and disclose information when reasonably necessary to prevent or investigate fraud, protect our business or customers, enforce our Terms of Service, evaluate a product or service claim, or respond to a payment dispute, chargeback, financing dispute, insurance claim, carrier claim, legal claim, or similar proceeding.

Information provided in connection with a dispute or claim may include order information, invoices, transaction records, applicable policies, customer communications, submitted production files or instructions, approvals, production records, production notes, photographs, shipping information, tracking information, delivery information, and other reasonably relevant business records.

We do not routinely create special photographs, videos, audio recordings, measurements, or forensic documentation of every product or production step solely in anticipation of a future dispute.

The absence of a particular photograph, recording, measurement, or other special production document does not prevent us from using other reasonably available business records to respond to a claim, dispute, or chargeback.

8. Cookies, Analytics & Advertising Choices

Our store uses cookies, pixels, local storage, and similar technologies. Necessary technologies support shopping-cart, checkout, account, payment, fraud-prevention, security, and core website functions. Shopify and service providers also process operational and diagnostic information to provide and secure these services.

Our Shopify cookie banner is configured to request consent to nonessential analytics, advertising, and personalization technologies from visitors in all regions. You can select Accept, Decline, or Manage preferences. You can return to Cookie preferences to review or change your choice. Declining optional tracking does not prevent placing an order, although some optional embedded content may remain unavailable.

Our store's integrations include Google & YouTube for advertising and measurement and Microsoft Clarity for website-use analysis. Depending on your consent, applicable opt-out choices, and the integration, these services may process device and browser identifiers, IP address, page and product interactions, referral and advertising information, and shopping events. Third-party providers may process data under their own privacy policies. Cookie consent is separate from subscribing to marketing email.

Advertising-related disclosure of device identifiers or website activity can be considered a sale, sharing, or targeted advertising under certain US privacy laws even when no money is exchanged for that information. You can use Your privacy choices — Do Not Sell or Share My Personal Information to submit an opt-out. This control is enabled across all 50 US states and the District of Columbia.

For visitors in those US regions, Shopify's privacy system recognizes the Global Privacy Control (GPC) opt-out preference signal as an opt-out of sale or sharing for that browser and device. Other browser settings, including legacy Do Not Track signals, may operate differently. You can also submit an opt-out using our privacy choices page.

Choices made on one browser or device might not carry over to another browser or device, and clearing browser data can remove a saved choice. You can contact info@lathecutvinylrecords.com for help or to exercise applicable privacy rights.

9. Marketing

Where permitted by law, we may use contact information to send information about our products, services, promotions, or business.

You may unsubscribe from promotional email using the unsubscribe mechanism contained in the applicable message.

Unsubscribing from marketing does not prevent us from sending transactional, production, account, legal, safety, shipping, or customer-service communications reasonably necessary to process or support an order or business relationship.

10. Disclosure of Personal Information

We may disclose personal information:

  • To Shopify and other providers necessary to operate our store
  • To payment processors, banks, and card networks
  • To shipping and delivery providers
  • To insurers or shipping-coverage providers where applicable
  • To technology, file-transfer, storage, and communications providers
  • To professional advisers
  • When you request or authorize the disclosure
  • To prevent or investigate fraud, abuse, or misuse
  • To enforce our agreements or protect our legal rights
  • To evaluate or respond to a product, shipping, or service claim
  • To respond to a chargeback, payment dispute, or financing dispute
  • When required by law, court order, subpoena, or other valid legal process
  • In connection with a merger, acquisition, financing, sale, restructuring, or transfer of all or part of our business

We do not disclose personal information merely because another person requests it.

11. Data Retention

We retain personal information for as long as reasonably necessary for the purposes for which it was collected, including fulfilling orders, maintaining transaction and business records, providing customer support, resolving disputes, preventing fraud, and satisfying legal, accounting, tax, regulatory, and other legitimate business requirements.

Different categories of information may be retained for different periods.

For example, customer production files may be deleted shortly after fulfillment while transaction, accounting, shipping, communication, fraud, claim, dispute, or legal records may be retained for substantially longer periods.

A request to delete personal information is subject to applicable law and does not require us to delete information that we are legally permitted or required to retain, including information reasonably necessary for transactions, accounting, tax obligations, fraud prevention, dispute resolution, legal claims, security, or compliance obligations.

12. Security

We use reasonable administrative, technical, and organizational measures appropriate to our business to protect information in our possession.

However, no internet transmission, electronic storage system, file-transfer system, email system, ecommerce platform, or security measure can guarantee absolute security.

Customers should avoid sending passwords, complete payment-card information, Social Security numbers, financial-account credentials, or other unnecessary sensitive information by ordinary email or as part of production materials.

13. Your Privacy Rights

Depending on where you live and applicable law, you may have rights concerning your personal information, which may include rights to:

  • Request access to certain personal information
  • Request correction of inaccurate information
  • Request deletion of certain information
  • Obtain certain information in a portable format
  • Object to or restrict certain processing
  • Opt out of certain targeted advertising, sharing, or sales where applicable

These rights are subject to applicable exceptions and legal requirements.

For example, a deletion request may not require deletion of information we are permitted or required to retain for completed transactions, tax and accounting records, fraud prevention, security, dispute resolution, legal claims, or other lawful purposes.

We may need to verify your identity before processing a privacy request.

Where permitted by applicable law, we may request information reasonably necessary to verify that the person making a request is the individual to whom the information relates or is properly authorized to act for that individual.

Submitting requests and appeals

To request access, correction, deletion, or a copy of your information, or to ask about applicable privacy rights, email info@lathecutvinylrecords.com. Include enough information to locate your relationship with us, such as an order number or the email used for your order. Please do not send passwords, full payment-card numbers, or government identification in your initial email. We will respond within the time required by applicable law and explain any permitted extension.

Where applicable law permits an authorized agent to act for you, we may request appropriate proof of authority and identity verification. If we deny a request, you may appeal by replying to our decision or emailing us with the subject Privacy Appeal. We will explain the result and any further complaint options required by applicable law. We will not unlawfully discriminate against you for exercising protected privacy rights.

14. Children

Our products and services are not directed toward children, and we do not knowingly collect personal information from children in circumstances prohibited by applicable law.

If you believe a child has provided personal information to us improperly, please contact us.

15. Third-Party Websites & Services

Our website, emails, invoices, or communications may contain links to third-party websites, services, file-transfer systems, payment services, shipping providers, or other platforms.

Those third parties operate under their own privacy policies and practices. We are not responsible for the privacy or security practices of websites, services, or platforms that we do not control.

16. International Processing

Shopify and other service providers used in operating our business may process or store information outside the state, province, or country where a customer lives.

Where required, such processing and transfers are subject to applicable legal requirements and safeguards.

17. Legal Requirements & Protection of Rights

We may preserve, use, or disclose information where reasonably necessary to:

  • Comply with applicable law or legal obligations
  • Respond to valid legal process
  • Respond to a court order, subpoena, or lawful government request
  • Protect our legal rights
  • Enforce our Terms of Service or other agreements
  • Investigate suspected fraud, abuse, or unlawful activity
  • Protect customers, our business, or others
  • Establish, exercise, or defend legal claims
  • Respond to payment, carrier, insurance, or other disputes

Where reasonably appropriate and permitted by law, information relevant to a claim or dispute may be preserved for longer than it otherwise would have been retained.

18. Business Transfers

If George W Paulin LLC or Lathe Cut Vinyl Records is involved in a merger, acquisition, financing, restructuring, sale of assets, sale of the business, or another business transaction, information may be disclosed or transferred as reasonably necessary in connection with that transaction and subject to applicable law.

19. Relationship to Other Policies

This Privacy Policy should be read together with our:

  • Terms of Service
  • Returns & Refund Policy
  • Shipping & Delivery Policy
  • Applicable product and service descriptions
  • Applicable FAQ provisions
  • Applicable checkout information
  • Applicable custom invoices or written agreements

Those policies may explain our production, manufacturing, payment, shipping, claim, and contractual practices. This Privacy Policy explains how personal information is handled in connection with those activities.

Nothing in another policy eliminates privacy rights that cannot legally be excluded or limited.

20. Changes to This Privacy Policy

We may update this Privacy Policy to reflect changes in our business, technology, products, services, service providers, production practices, privacy practices, or legal requirements.

The current version will be posted on our website with its updated revision date.
