Welcome to Lathe Cut Vinyl Records, operated by George W Paulin LLC.

For purposes of these Terms, “Lathe Cut Vinyl Records,” “we,” “our,” and “us” refer to George W Paulin LLC, doing business as Lathe Cut Vinyl Records.

By accessing our website, placing an order, paying an invoice, submitting files, approving production materials, or purchasing or using our products or services, you agree to these Terms of Service and any applicable product-specific terms, policies, specifications, preparation instructions, and ordering requirements.

You must be at least 18 years old and have the legal capacity and authority to enter into this agreement and purchase the products or services ordered.

Please review your order, files, specifications, quantities, services, compatibility requirements, shipping information, and selections carefully before purchasing or approving production.

1. Products & Services

Lathe Cut Vinyl Records is a specialty record-manufacturing, audio, creative, technical, and professional-supply business. Products and services may include:

• 7-inch, 10-inch, 12-inch, shaped, specialty, and other custom lathe-cut records
• Single-sided, double-sided, specialty-speed, specialty-groove, picture, decorative, and custom record configurations
• Vinyl Mastering
• Streaming Mastering
• Side Sequencing
• CD / DDP and production-master preparation
• Rush production
• Printed center labels
• Record jackets, sleeves, inserts, lyric sheets, and printed products
• CNC engraving and specialty artwork
• PETG and other record blanks
• Diamond recording styli
• Stylus shanks, collets, heat-wire products, cleaning products, and related cutting supplies
• Anti-static, cleaning, maintenance, and other liquid products
• Gift cards
• Recording, mixing, voice-over, transfer, digitization, restoration, and studio services
• Technical or professional audio services
• Custom, commercial, prototype, bulk, and specialty manufacturing

This list is illustrative and does not limit the products or services we may offer.

Product pages, FAQ pages, preparation instructions, checkout information, custom invoices, and written order-specific communications may contain additional specifications, requirements, limitations, warnings, or instructions applicable to a particular product or service.

Prices, products, specifications, services, availability, materials, and production estimates may change before an order is placed.

We may refuse, suspend, limit, or cancel an order where reasonably necessary, including where an order cannot reasonably or safely be manufactured or fulfilled, violates our policies, may violate applicable law or third-party rights, involves unavailable materials or capacity, or involves fraudulent, abusive, threatening, or unlawful conduct.

2. Custom Lathe-Cut Records

Lathe-cut records are individually manufactured records and are not traditionally mass-produced pressed records.

The general custom-record provisions of these Terms apply to playable lathe-cut records regardless of whether the outside configuration is a conventional 7-inch, 10-inch, or 12-inch circle, a shaped record, or another custom or specialty configuration.

A shaped record containing playable grooves is still treated as a custom lathe-cut record for purposes of these Terms.

Product-specific dimensions, speeds, playable areas, maximum program lengths, artwork areas, engraving areas, center-label configurations, and other specifications may vary and are determined by the applicable product page, custom order, or written specification.

3. Production Files & Customer Responsibility

Customers are responsible for submitting complete, final, correctly organized production materials according to the requirements applicable to the products and services purchased.

Customer-submitted or customer-approved materials determine what we manufacture. Customers are responsible for confirming the correct songs, versions, mixes, masters, song order, sequencing, side assignments, artwork, names, spelling, PQ information, metadata, dimensions requested for custom work, and other production information.

If submitted audio, artwork, and other materials appear reasonably usable for the products and services purchased, Lathe Cut Vinyl Records may proceed with production without contacting the customer for additional confirmation, proofreading, creative approval, or explanation.

Our production process is not a comprehensive pre-production audit, forensic file inspection, creative consultation, or customer-approval service unless such work is expressly included in a separately purchased service.

We are not obligated to identify every potential customer error, artistic choice, unusual characteristic, inconsistency, or possible improvement before production.

Our decision to notice, question, discuss, or correct one issue does not create an obligation to identify, question, or correct every other issue.

Customer-submitted or customer-approved errors are not manufacturing defects.

4. Customer Responsibility for the Musical Program

Customers are responsible for supplying the correct musical program and accurate production information.

When a customer supplies completed Side A and Side B files, those files establish the customer's musical program. The customer controls the songs, versions, song order, audible silence, gaps, fades, overlaps, crossfades, transitions, and other musical timing contained within those completed files.

Lathe Cut Vinyl Records does not automatically redesign or correct those musical decisions merely because we manufacture the record.

If completed files are reasonably usable for the product purchased, we may proceed with them as supplied, subject to the technical processing and physical cutting decisions described in these Terms.

5. Scope of Audio Services

Audio services have different scopes. Purchasing one audio service does not automatically include another except where the purchased service expressly includes related work, such as Per-Song Vinyl Mastering that includes assembly of mastered songs into completed Side A and Side B programs.

• Per-Song Vinyl Mastering processes individual songs and, for multi-song record programs, includes assembly of the mastered songs into completed sides according to the customer's supplied PQ information.
• Side Sequencing assembles individual songs into completed sides.
• Included Whole-Side Premastering prepares completed sides as whole programs for physical cutting.

Unless expressly included in the purchased service, audio services do not include remixing, stem mixing, restoration, forensic audio analysis, creative production, selection between alternate mixes, songwriting decisions, sequence redesign, or unlimited revisions.

Included Whole-Side Premastering

Basic whole-side premastering is included with applicable lathe-cut record production.

Whole-side premastering is performed on completed Side A, Side B, and any additional completed sides as whole programs for physical cutting.

It may include reasonable whole-side gain adjustment, filtering, frequency management, bass management, stereo or phase management, dynamics control, fades, shortening where reasonably necessary to fit the selected format, or other technical processing we determine appropriate for reliable record cutting, playable results, or protection of the cutting system.

Included whole-side premastering is not individual-song mastering and does not include independent song-to-song normalization or level matching.

If one song contained within a completed side is quieter or louder than another, whole-side premastering does not require us to independently turn that song up or down, independently EQ or compress it, or otherwise master that song separately.

Differences between songs contained within the completed side may therefore remain in the finished record.

Per-Song Vinyl Mastering

Per-Song Vinyl Mastering is a separate paid service performed at the individual-song level.

Depending on the source material, Per-Song Vinyl Mastering may include reasonable individual adjustments to gain, level, frequency balance, filtering, dynamics, bass, stereo or phase relationships, sibilance, high-frequency content, or other characteristics relevant to vinyl reproduction.

Where multiple songs are being prepared for the same release, Per-Song Vinyl Mastering may include reasonable song-to-song level or tonal adjustments intended to improve consistency across the program.

Per-Song Vinyl Mastering does not guarantee identical perceived loudness, LUFS values, peak levels, tonal balance, dynamics, frequency response, or physical cutting level among different songs.

For multi-song record programs, Per-Song Vinyl Mastering includes reasonable assembly and sequencing of the mastered songs into completed Side A and Side B programs according to the customer's supplied PQ information. A complete and accurate PQ sheet or equivalent accepted production information is required for multi-song sides.

Per-Song Vinyl Mastering does not automatically include creative album production, remixing, restoration, selection between alternate versions, or another service not expressly included.

Side Sequencing

Side Sequencing is a separate paid service intended for customers who have individual song files but do not have completed Side A and Side B programs.

When Side Sequencing is purchased, the customer supplies the individual songs together with the required PQ sheet or other accepted production information.

We assemble those individual songs into the applicable completed sides according to the customer's supplied program information and establish conventional track separation as appropriate.

After sequencing, each completed side is treated as a whole program for included whole-side premastering and physical cutting.

Side Sequencing does not itself include Per-Song Vinyl Mastering.

Side Sequencing therefore does not automatically include individual-song normalization, level matching, EQ, compression, restoration, or other individual-song mastering.

Customers submitting individual song files that require us to assemble those songs into completed sides must purchase Side Sequencing.

Merely supplying individual files, a PQ sheet, track list, timestamps, or instructions does not itself purchase Side Sequencing.

Streaming Mastering

Streaming Mastering is intended for digital distribution or other applicable digital use and is separate from physical lathe-cut production.

Streaming Mastering applies to the particular submitted mix or version. Submitting a different or revised mix after mastering may require new paid mastering work unless otherwise agreed.

A later change in creative direction or preference does not by itself establish that the originally completed mastering service was defective.

CD / DDP & Production Masters

Where offered, CD / DDP or other production-master preparation may include the applicable mastering, sequencing, PQ, metadata, or production-master work described in the purchased service.

Customers remain responsible for supplying complete and accurate PQ, track, metadata, and program information requested for the project.

Masters prepared for a third-party pressing plant or manufacturer are not subject to our physical lathe-cut track-band limitations unless expressly stated otherwise.

DJ, Maxi, Half-Speed & Specialty Cuts

Where offered, DJ, maxi, half-speed, unusually loud, locked-groove, inside-out, specialty-speed, or other specialty cuts are subject to the specifications of the applicable product.

Purchasing Vinyl Mastering, Side Sequencing, DDP, or another audio service does not automatically purchase a specialty physical cutting configuration.

Requested cutting level remains subject to program length, source material, groove geometry, bass, stereo information, dynamics, equipment limitations, and safe operation of the cutting system.

We may reasonably modify or refuse a requested physical cutting parameter where necessary for manufacturing or equipment protection.

6. PQ Sheets & Multi-Track Audio

For Side Sequencing, Per-Song Vinyl Mastering involving multiple songs on a side, DDP, or another audio service for which we request detailed multi-track program information, the customer must provide a complete and accurate PQ sheet or equivalent production information accepted by Lathe Cut Vinyl Records.

PQ information should identify, where applicable, track titles, song order, Side A / Side B assignments, additional side assignments such as C / D, timing information, metadata, and other requested production information.

Customers are responsible for ensuring PQ information is accurate and consistent with submitted audio and other instructions.

Missing, incomplete, or conflicting PQ information may delay production.

A PQ sheet is not required for an ordinary custom-record order where the customer supplies completed Side A and Side B files and the intended musical program and track changes are already reasonably clear from those files, unless we specifically request additional production information. Customers requesting particular visible track-band locations should submit a PQ sheet identifying the intended positions; such information is a production reference and does not guarantee exact mechanical placement or that a visible band will be made.

PQ sheets, timestamps, cue sheets, track lists, filenames, artwork, order notes, and emails communicate information about the intended program. They do not independently dictate exact physical groove geometry, groove-band width, cutting level, groove pitch, or other technical manufacturing parameters.

7. Conflicting, Ambiguous or Incomplete Instructions

Customers are responsible for supplying production materials that are complete, accurate, and reasonably consistent with one another.

If audio files, PQ information, filenames, timestamps, track lists, artwork, emails, order notes, or other instructions conflict, are ambiguous, or appear incomplete, Lathe Cut Vinyl Records may either pause production and request clarification or, where the intended program can reasonably be determined, proceed using reasonable professional and technical judgment based on the available materials and services purchased.

We are not required to contact the customer regarding every inconsistency or potential issue where the submitted materials are reasonably usable for production.

Our decision to ask about one discrepancy does not create an obligation to discover or obtain clarification regarding every other discrepancy.

Where conflicting information concerns technical execution of a physical record, Lathe Cut Vinyl Records retains reasonable technical discretion to determine how the program can appropriately be manufactured.

Official Checkout Email & Order Communications

Customers must use the same email address when contacting us about a project, placing the order at checkout, submitting production information, and communicating about that order after purchase. If a customer contacts us before checkout, the customer must use that same email address when placing the order, and vice versa.

The email address entered at checkout is the official contact email for that order. When reviewing correspondence to prepare, manufacture, or fulfill an order, Lathe Cut Vinyl Records ordinarily references the order record, files submitted through our accepted channels, and communications associated with that checkout email address.

We are not required to search for, identify, merge, or cross-reference separate email threads or messages sent from other email addresses, even if those messages concern the same customer, artist, project, or order. Customers must not assume that instructions sent from another address have been linked to their order.

Special requests, artwork changes, audio instructions, shipping changes, approvals, or other order-related directions sent from an email address different from the checkout email are not automatically incorporated into the order. We may decline to act on them until the sender is verified and the instructions are confirmed through our accepted order-communication process.

To the extent permitted by applicable law, we are not responsible for missed requests, delays, or discrepancies caused by a customer's use of inconsistent email addresses or failure to provide instructions through the required ordering channels. This does not excuse our failure to follow instructions that we expressly accepted as part of the order or any obligation imposed by applicable law.

Customers who need to change their order email should request the change from the original checkout email where possible. We may require reasonable identity or order verification before recognizing another address. Copying another email address on a message does not, by itself, verify the sender or amend the order.

All required production files and final specifications must still be supplied through the accepted submission process and within the applicable deadlines. Email correspondence alone does not replace checkout selections, required file submissions, or a separately purchased service.

8. Track Separation & Physical Groove Bands

Audible track separation and visible physical groove bands are related but separate characteristics.

For completed sides containing multiple songs, Lathe Cut Vinyl Records reviews the audio to identify customer-established or sequencing-established silence, low-level sections, gaps, fades, transitions, or other apparent song boundaries.

Those locations are used as references for determining physical groove-band placement.

Approximately two seconds of complete silence between songs is recommended where a conventional visible track separation is desired, unless the program intentionally uses another transition. Low-level audio may be considered as a technical reference at our discretion, but is not equivalent to a guaranteed silent gap.

Our standard physical lathe-cut format supports up to five physical track sections per side separated by a maximum of four visible groove bands.

When a side contains five or fewer songs, we generally use the established song transitions as references for applicable physical groove bands, subject to the technical requirements of the cut.

If a completed side contains more than five songs or more than four potential track separations, Lathe Cut Vinyl Records may combine multiple songs within the same physical track section.

We use reasonable technical judgment to determine which established transitions work best for the available physical groove bands based on the submitted program, available recording area, groove spacing, program length, cutting level, and other physical cutting requirements.

For example, if a side contains six songs, all six songs may remain fully present and play in their intended order while only four transitions receive visible physical groove bands. Two adjacent songs may therefore share a physical track section.

This does not mean songs have been deleted, reordered, or musically combined. It means only that a visible physical groove band is not necessarily created between every song.

In some circumstances we may elect to create an additional physical division where technically feasible. Doing so is discretionary and does not create a guaranteed specification, entitlement, or precedent for another record, program, copy, or order.

Silence, Track Separation & Physical Bands

Approximately two seconds of complete silence between songs is generally recommended when the customer wants a conventional visible physical track band. A low-level transition may be evaluated at our discretion but does not guarantee a visible band.

When a customer supplies a completed Side A or Side B file containing approximately two seconds or more of complete silence between songs, Lathe Cut Vinyl Records may interpret that area as the customer's request, authorization, or production reference for conventional physical track separation unless the customer provides contrary instructions before production.

Customer-created or sequencing-established silence is part of the submitted musical program; however, where that silence or low-level area is being used for physical track separation, the cutting process may require reasonable technical modification of that transition area.

When creating a visible physical groove band, Lathe Cut Vinyl Records may reasonably shorten, extend, replace, reposition, or otherwise adjust silent or sufficiently low-level portions of a completed Side A or Side B file as part of the physical cutting process.

This may include beginning the physical separation before the full submitted silence has elapsed, extending the non-program or separation area where technically appropriate, or otherwise modifying the silent or low-level transition so that the physical band can be created appropriately by the cutting system.

A physical groove band is created during record manufacturing and is not required to reproduce the exact duration, width, waveform, sample location, or digital timing of the silence contained in the submitted audio file.

The duration of customer-supplied silence therefore does not determine the required physical width or exact duration of the resulting physical groove band or separation area.

For example, approximately two seconds of silence in a submitted Side A or Side B file may be used as the production reference for a conventional track band, but the finished physical separation is not guaranteed to contain exactly two seconds of unchanged digital silence or to begin and end at the exact digital sample, second, or frame contained in the submitted file.

Longer silent areas may likewise be shortened, preserved, extended, or otherwise treated as reasonably appropriate for the purchased service, musical program, available recording area, and physical cutting requirements.

Customer-supplied silence, PQ information, timestamps, cue information, waveform locations, track lists, or other track-boundary information are production references and do not independently establish an exact physical groove-band location, width, duration, or geometry.

The presence of silence, low-level audio, or an apparent track boundary does not require Lathe Cut Vinyl Records to create a visible physical groove band. Where technically appropriate, we may create a physical groove band, adjust the silent or low-level transition as described above, use another appropriate physical treatment, or make no physical separation at all and allow the program to continue playing continuously through that transition.

Customers who require a continuous cut, seamless transition, preservation of a particular silent duration, no visible physical track band at a particular transition, or another specific treatment must clearly communicate that requirement before production and obtain our acceptance where the requirement constitutes a specific physical manufacturing specification.

Any adjustment to a silent or sufficiently low-level transition must be reasonably related to physical cutting. We do not intentionally remove, reorder, or substitute musical content as a routine track-banding operation. Specific seamless or precisely timed transitions that we expressly accept in writing will be handled according to that accepted requirement, subject to applicable technical limitations.

Exact band placement, width, visibility, groove spacing, pitch, duration, and execution remain technical manufacturing decisions of Lathe Cut Vinyl Records, subject to any specific physical specification or tolerance expressly accepted by us in writing.

Seamless, Crossfaded & Continuous Programs

Programs containing intentional overlaps, crossfades, continuous mixes, seamless transitions, or little or no silence may be cut continuously.

Where a physical band is appropriate, we may use PQ information, timestamps, waveform or spectral information, musical transitions, low-level material, or other available program information as references.

A timestamp or PQ entry does not guarantee that a visible physical groove band will occur at that exact digital sample, second, or frame unless an exact physical specification or tolerance has been expressly accepted by us in writing.

9. Final Technical Authority for Physical Cutting

Lathe Cut Vinyl Records retains final reasonable technical authority over the physical execution of records we manufacture.

This includes reasonable decisions concerning cutting level, filtering, EQ, frequency management, de-essing, bass, stereo or phase information, dynamics, fades, program shortening where reasonably necessary, groove pitch, groove spacing, recording area, physical track-band placement, band width, band visibility, and other technical adjustments reasonably necessary to fit the selected format, manufacture a playable record, or protect the cutting system.

Program length, cutting level, dynamics, limiting or compression, bass, stereo or phase content, high-frequency content, track count, physical bands, and other characteristics can affect the physical recording area required.

We may adjust groove pitch, spacing, cutting level, filtering, EQ, de-essing, bass or stereo information, dynamics, fades, program length, or related technical parameters as reasonably necessary to accommodate the program, fit the selected format, produce a playable record, or protect the cutting system.

Digital waveform appearance, peak level, LUFS measurement, PQ timing, or the settings or appearance of another record do not independently establish the required physical cutting level, groove pitch, groove width, or physical layout of a particular record.

Purchased Runtime Limits & Diamond Cutting Time

Each purchased runtime option includes a specific maximum audio program length and the corresponding diamond cutting time required to manufacture that program. For example, purchasing a 15-minute side includes up to 15:00 of audio, not 15:59, even if the physical record format could accommodate more.

Minor overages of up to approximately 15 seconds may be accommodated at our discretion but are not guaranteed. This discretionary allowance does not increase the purchased runtime limit or entitle a customer to additional cutting time.

If submitted audio exceeds the purchased runtime, Lathe Cut Vinyl Records may stop cutting at approximately the purchased time limit without obtaining additional customer approval, provided the runtime limit and this consequence were clearly disclosed before checkout. The resulting record may end abruptly, contain an incomplete song, or omit audio beyond the purchased limit. We are not obligated to apply a fade-out, preserve a musical ending, or provide additional diamond cutting time without payment or express approval.

This applies to all purchased runtime options, including 4, 6, 8, 15, 18, and 20 minutes, and any other limit stated for a product. Customers are responsible for ensuring each completed side fits within the runtime purchased. Where submitted files are materially incompatible with the ordered product, we may instead pause production and request corrected files or a change of option. Nothing in this section limits rights or remedies that cannot lawfully be waived.

10. Record Sizes, Shapes, Dimensions & Custom Configurations

Custom lathe-cut records may be manufactured in standard or non-standard sizes, shapes, playable areas, and configurations.

The same general record-production provisions apply to conventional circular records and shaped or custom records containing playable grooves.

For custom orders, Lathe Cut Vinyl Records may agree to a particular size, shape, playable area, center-hole configuration, engraving area, or other physical specification.

Unless a specific dimensional tolerance is expressly accepted by us in writing, stated physical dimensions are nominal production specifications and are subject to reasonable manufacturing tolerances.

A drawing, reference image, requested dimension, product name, or preliminary discussion does not by itself establish a precision machining tolerance.

Customers requiring a critical dimensional tolerance for a machine, fixture, packaging system, commercial application, or other purpose must disclose that requirement and obtain our express written acceptance before ordering.

11. Physical Materials, Cosmetic Characteristics & Manufacturing Tolerances

Many products sold by Lathe Cut Vinyl Records are individually cut, CNC machined, fabricated, printed, engraved, handled, assembled, or otherwise produced in small quantities.

Reasonable manufacturing and material characteristics may include minor scratches, scuffs, marks, nicks, edge characteristics, machining marks, protective-film marks, surface variation, minor dimensional variation, color variation, or other cosmetic characteristics that do not materially prevent the product from performing its intended function.

These principles may apply, as appropriate, to finished records, PETG blanks, shaped records, engraved products, printed components, jackets, labels, and other fabricated products.

A minor cosmetic mark, nick, scratch, scuff, machining characteristic, or reasonable dimensional variation does not by itself establish a manufacturing defect.

This provision does not excuse a material failure to substantially conform to an expressly accepted product specification.

12. Individually Cut Records & Manufacturing Variation

Every lathe-cut record is individually manufactured.

Reasonable copy-to-copy variation may occur in cutting level, perceived level, groove geometry, groove spacing, physical track bands, surface appearance, surface noise, frequency response, distortion characteristics, printing, assembly, or other characteristics inherent to individually manufactured records.

Two records cut from the same approved program are not guaranteed to be physically or sonically identical in every measurable or visible respect.

A sample, test copy, first copy, or previous production result does not establish an exact specification for every later copy unless we expressly accept a specific tolerance in writing.

Reasonable manufacturing variation does not by itself constitute a defect.

Sample Copies & Bulk Orders: Customers ordering multiple copies are strongly encouraged to purchase and evaluate a single sample record before placing a larger order. Lathe-cut records are individually manufactured, and reasonable sonic, cosmetic, and physical variations may occur between copies. Customers who proceed with a larger order without first evaluating a sample acknowledge these disclosed manufacturing characteristics. A sample does not guarantee that subsequent copies will be identical. This provision does not exclude remedies for verified manufacturing defects or rights protected by applicable law.

13. Unique A / B Programs & Additional Programs

One unique Side A / Side B combination constitutes one production program.

Additional unique side pairs such as C / D, E / F, G / H, or additional unique A / B combinations constitute separate production programs even when they belong to the same album, artist, release, customer, invoice, or project.

Each unique program must ordinarily be purchased through its own applicable checkout/order unless Lathe Cut Vinyl Records provides a custom invoice or expressly approves another ordering arrangement.

A custom invoice may combine payment administratively but does not convert different programs into one production program.

Different programs may require different cutting levels, groove pitch, filtering, physical band placement, or other settings.

The settings or results used for A / B do not establish the required settings or results for C / D or another program.

14. Production, Premastering, Handling, Packaging & Fulfillment Structure

For standard non-jacketed custom-record orders, the standard $10 charge applies to each group of up to 10 identical records of the same unique A / B production program.

This charge is part of our production and fulfillment structure and is not solely a pass-through postage charge.

The charge contributes to the applicable production workflow, included whole-side premastering, order handling, packaging, shipping preparation, fulfillment, and standard USPS Media Mail postage when applicable.

• 1–10 identical non-jacketed records of the same program: $10
• 11–20: $20
• 21–30: $30

The same structure continues in groups of up to 10 unless another arrangement is stated on the applicable product page, checkout, custom invoice, or written agreement.

Each additional unique production program begins its own applicable production and fulfillment group.

For example, 10 copies of A / B and 10 copies of C / D are two separate production programs and are not treated as 20 identical copies of one program.

For standard non-jacketed orders, up to 10 identical records of the same production program may be packaged in one standard record mailer.

For jacketed records, standard packaging capacity is up to 5 jacketed records per mailer, subject to the applicable production, packaging, handling, and fulfillment structure.

15. Quantity Discounts

Quantity-based pricing or discounts apply only according to applicable product pricing and qualifying identical copies of the same program and configuration.

Different programs, alternate audio, alternate artwork configurations, or other materially different products cannot be combined solely to reach an identical-copy quantity tier unless expressly approved.

16. Artwork, Printing, Labels, Jackets & Printed Products

Lathe Cut Vinyl Records is primarily an audio and physical record-production business. Artwork, printing, center-label, jacket, insert, lyric-sheet, and related services are streamlined small-run production services rather than comprehensive commercial prepress or graphic-design services unless expressly sold as such.

Unless specifically purchased, artwork services do not include professional color grading, Pantone or spot-color matching, calibrated proofs, unlimited revisions, repeated test prints, physical prototypes, or extensive graphic design.

By submitting artwork, the customer authorizes reasonable sizing, scaling, positioning, cropping, stretching, and other production adjustments needed to fit our standard production format or the purchased product.

Printed color can vary because of source files, displays, inks, paper or label stock, coatings, printing equipment, and other physical production factors. Exact screen-to-print color matching is not guaranteed unless expressly agreed.

Hand-applied jackets, labels, and printed components may exhibit reasonable small-run characteristics including minor bubbles, air pockets, wrinkles, edge lifting, alignment variation, trimming variation, adhesive characteristics, curling, or minor edge and corner variation.

Reasonable cosmetic characteristics that do not materially prevent the product from functioning or substantially conforming to the purchased product are not necessarily defects.

Center Labels

Center-label specifications depend on the applicable record product. Customers preparing artwork must follow current templates and preparation instructions.

Plain white center labels supplied as part of a finished-record product are applied to the finished record and are not supplied as loose printable label sheets unless a separate product expressly states otherwise.

Record Jackets

For applicable 12-inch tip-on jackets, front and back artwork is produced as separately printed adhesive artwork panels that are applied to the front and back of the jacket, with a finished spine. These are small-run assembled jackets and are not represented as directly printed commercial offset jackets.

For applicable 7-inch jacket packages, front and back artwork may be produced as separate printed cardstock panels used with the applicable clear slip-on outer sleeve, as described on the product page or artwork instructions.

17. CNC Engraving

CNC engraving is a physical manufacturing process and may differ from the appearance of digital artwork.

We may reasonably scale, position, simplify, convert, orient, mirror, or otherwise prepare artwork for the applicable engraving process.

Unless expressly purchased, CNC engraving does not include repeated physical prototypes, test engravings, test fits, or unlimited artwork revisions.

For applicable clear single-sided audio products, Side A may contain audio while Side B contains CNC engraving. Engraving may be inverted, mirrored, or oriented as reasonably necessary for its intended viewing orientation.

For applicable products supporting engraving on more than one side, the available audio and engraving configuration is determined by the applicable product.

Reasonable differences between digital artwork and physical engraving do not by themselves constitute manufacturing defects.

18. Record Blanks & PETG Materials

Record blanks, including PETG products, are specialty materials intended for compatible record-cutting, fabrication, or related applications.

Unless expressly stated otherwise, dimensions are nominal production specifications rather than precision-certified dimensions.

Reasonable variation may occur in diameter, thickness, center-hole dimensions, flatness, edge finish, surface appearance, color, protective film, machining marks, and other physical characteristics associated with sheet material, CNC machining, handling, and production.

Minor scratches, scuffs, marks, nicks, edge characteristics, film marks, or other cosmetic characteristics that do not materially prevent the blank from performing its intended function do not by themselves establish a manufacturing defect.

Customers are responsible for determining whether the blank's material, dimensions, thickness, flatness, center hole, surface, and other characteristics are suitable for their particular lathe, platter, vacuum system, cutting method, stylus, fixture, packaging, or other equipment.

Customers requiring a critical dimensional tolerance or other critical specification must disclose that requirement and obtain our express written acceptance before ordering.

Material recommendations do not guarantee compatibility with every cutting system, stylus, temperature, speed, depth, heating method, or operating configuration.

Removing protective film, cutting, engraving, machining, drilling, cleaning, modifying, or otherwise using a blank may alter its original condition and may limit our ability to determine whether an alleged condition existed before use.

19. Diamond Recording Styli & Precision Cutting Tools

Diamond recording styli, shanks, collets, heat-wire components, and related cutting products are precision professional tools intended for knowledgeable users operating compatible equipment.

Customers are responsible for verifying compatibility, installation, alignment, orientation, heating, cutting depth, cutting angle, material compatibility, operating settings, cleanliness, handling, and safe operation.

Diamond stylus life is not guaranteed for a specific number of hours, records, grooves, cuts, or operating cycles.

Service life can vary substantially based on material, heat, alignment, cutting depth, cutting level, contamination, handling, operator technique, equipment condition, and other operating factors outside our control.

Customers should inspect precision cutting tools before installation and report an apparent manufacturing or shipping defect within the applicable claim period and, where reasonably possible, before using the tool.

Chips, fractures, wear, burns, contamination, bent or damaged shanks, damaged heat wires, or other damage occurring after installation or use do not by themselves establish an original manufacturing defect.

Lathe Cut Vinyl Records is not responsible for damage caused by improper installation, accidental contact, cutter-head crashes, excessive or inappropriate heat, incompatible material, improper cutting depth, misalignment, contamination, modification, misuse, or other conditions outside our control, except to the extent applicable law requires otherwise.

20. Stylus Resharpening, Repair & Reattachment Services

Where offered, stylus resharpening, heat-wire reattachment, repair, modification, or related technical services are performed on delicate customer-owned components.

Used precision components may contain pre-existing wear, damage, contamination, fractures, deformation, adhesive residue, heat damage, or other conditions that are not always visible before work begins.

We do not guarantee that every used or damaged component can be successfully restored or that a repaired component will have the same service life as a new component.

We may decline work where a component appears unsuitable for the requested service.

Customers should package delicate components appropriately for shipment. Shipping damage occurring before we receive a customer-owned component is not a service defect attributable to Lathe Cut Vinyl Records.

21. Anti-Static, Cleaning, Maintenance & Liquid Products

Anti-static products, cleaning products, maintenance liquids, stylus-related liquids, and similar products, including products such as Anti Static Ooze, must be used only for their intended purpose and according to the applicable product instructions and safety information.

Customers are responsible for determining compatibility with the particular record material, stylus, equipment, finish, coating, adhesive, label, electronic component, tool, or other surface or equipment on which a product will be used.

Where compatibility is uncertain, customers should test the product on a small or inconspicuous area before broader application where reasonably appropriate.

Lathe Cut Vinyl Records does not guarantee compatibility with every plastic, record compound, coating, finish, adhesive, metal, stylus, electronic component, machine, or other material or equipment.

Results may vary based on the amount applied, application method, material, surface condition, contamination, temperature, humidity, equipment, storage, and other conditions outside our control.

Customers are responsible for proper storage, handling, application, ventilation, cleanup, and disposal in accordance with the product instructions and applicable law.

Customers must follow any warnings, safety information, manufacturer instructions, or other handling information supplied with or applicable to the product.

Products should be kept away from children, pets, food, eyes, skin, electrical components, heat, ignition sources, or other sensitive areas where indicated by the applicable product instructions or safety information.

Lathe Cut Vinyl Records is not responsible for damage caused by misuse, over-application, incompatible materials, improper storage, improper application, mixing with another substance, use contrary to supplied instructions, or another condition outside our reasonable control, except where applicable law requires otherwise.

22. Shipping of Liquids & Products Subject to Carrier Restrictions

Liquids, maintenance products, cleaning products, chemicals, and other regulated or carrier-restricted products may be subject to special packaging, transportation, routing, quantity, geographic, ground-transport, or other shipping requirements.

The availability of a shipping service for another product does not guarantee that the same shipping service is available for a liquid or regulated product.

Where required by applicable carrier rules or law, we may change the shipping method, use ground transportation, separate a product from other items, limit quantities, refuse air transportation, restrict international shipment, or cancel an unavailable shipping arrangement.

We will not knowingly ship a product by a method prohibited by applicable transportation or carrier requirements.

A customer request for expedited, air, international, or another shipping service does not require Lathe Cut Vinyl Records to use that service where the contents are not eligible.

Some liquids may be unavailable for shipment to particular locations or through particular carriers.

Where an order cannot legally or reasonably be shipped using the selected method, we may contact the customer regarding an alternative method or other appropriate resolution.

Customers must not reship, forward, transport, or use products in violation of applicable transportation, postal, carrier, import, export, or safety requirements.

Liquid Packaging, Leakage & Temperature

We use packaging we determine reasonably appropriate for the applicable product and shipping method.

Liquids may experience changes in viscosity, appearance, pressure, or other physical characteristics because of temperature or transportation conditions.

Customers should inspect liquid-product shipments after delivery and report material leakage, container failure, or shipping damage within the applicable claim period.

Minor residue around a closure or other condition that does not materially affect the usable quantity or safe intended use of the product does not necessarily establish a product defect.

A materially leaking, broken, or damaged container attributable to packaging or shipping may be evaluated under our claims procedure.

23. Professional Equipment & Product Safety

Products used for record cutting, machining, studio work, cleaning, maintenance, fabrication, or other professional applications may involve sharp tools, fragile precision components, heated components, rotating equipment, electrical equipment, liquids, machinery, and other hazards.

Customers are responsible for understanding and safely operating their own equipment and for using appropriate training, machine guarding, ventilation, personal protective equipment, electrical precautions, and safe operating practices appropriate to the particular application.

Information supplied by Lathe Cut Vinyl Records is not a substitute for the instructions supplied by the manufacturer of the customer's equipment, professional training, workplace safety requirements, or applicable law.

Customers should stop using a product or process if it appears damaged, unsafe, incompatible, or otherwise unsuitable for the intended application.

24. Gift Cards

Gift cards may be redeemed for eligible products or services according to the conditions displayed at purchase and applicable law.

Gift cards are not redeemable for cash except where required by applicable law.

Customers are responsible for safeguarding gift-card codes and account access. We may require reasonable verification before assisting with a lost, compromised, or disputed gift-card balance.

Gift-card expiration, fees, refunds, and redemption rights are governed by applicable law and any lawful terms displayed with the gift card.

Nothing in these Terms limits gift-card rights that cannot legally be waived.

25. Recording, Studio, Transfer, Restoration & Professional Services

Recording, mixing, dub mixing, voice-over, reel-to-reel, digitization, archival transfer, restoration, production sessions, technical support, and other professional services are limited to the scope and time purchased.

A scheduled session or purchased block of professional time does not include unlimited revisions, editing, restoration, mixing, mastering, troubleshooting, file management, consultation, or additional work unless expressly included.

Audio restoration, recovery, transfer, or archival services cannot guarantee complete recovery of damaged, degraded, incomplete, noisy, worn, or otherwise compromised source material.

Customers should retain backups of all original digital materials and, where possible, should not submit their only irreplaceable copy of important source material without understanding the risks associated with transportation and technical handling.

Subjective artistic dissatisfaction does not by itself establish that a professional service was defective where the purchased work was substantially performed according to the agreed scope.

26. Custom, Commercial, Prototype & Bulk Production

Custom, commercial, wholesale, reseller, blind-shipping, bulk, prototype, specialty, or unusual production arrangements may be subject to additional written specifications, pricing, minimums, schedules, or production terms.

Custom manufacturing may include non-standard dimensions, shapes, materials, machining, engraving, packaging, audio configurations, or other specifications.

Unless a specific tolerance is expressly accepted in writing, requested physical measurements remain subject to reasonable production tolerances.

A quote, estimate, conversation, drawing, sample, or preliminary discussion does not guarantee capacity, pricing, schedule, dimensional tolerance, physical layout, cutting level, or a particular subjective result unless expressly accepted as part of the order.

Our standard products do not include unlimited engineering, mastering, sequencing, file management, revisions, testing, correspondence, troubleshooting, documentation, or project-management time.

27. Rush Production & Production Estimates

Standard production estimates are for records without custom printed artwork or packaging. Ordinary custom-record orders without printed artwork are typically produced within approximately 3–14 business days after all required usable materials have been received.

Orders with printed artwork: Printed center labels, custom jackets, artwork preparation, printing, and assembly may add up to one additional week beyond the standard production estimate.

Larger runs with artwork: Larger orders requiring printed jackets, center labels, extensive packaging, or additional assembly may require one to two additional weeks beyond the standard production estimate. Larger runs without artwork may also take longer depending on quantity, complexity, materials, and current production volume.

Artwork preparation and packaging assembly are additional production processes; they are not necessarily included within the standard 3–14 business day record-cutting estimate. Holiday periods, high order volume, material availability, equipment needs, and other production circumstances may further extend estimated turnaround times.

Production timing begins only after all required audio, artwork, PQ information, order details, and other required materials have been received and are reasonably usable for production. Payment alone does not reserve production time while required materials remain outstanding.

All production times are estimates unless we expressly accept a guaranteed production deadline in writing. Production time and shipping transit time are separate, and a shipping estimate does not constitute a guaranteed delivery date.

Rush production changes production priority according to the particular Rush service purchased. It does not automatically eliminate artwork preparation, printing, assembly, or other production requirements, and does not waive technical requirements, customer file requirements, material availability, carrier limitations, or circumstances outside our reasonable control.

Expedited shipping and expedited production are separate. We may decline Rush work where we reasonably determine that the project cannot be completed safely or appropriately within the requested schedule.

Basic Rush with USPS Media Mail is available for 1–100 records at $40 per started group of 10. Priority Mail ($60 per started group of 10) and Priority Mail Express ($120 per started group of 10) are available for 25–100 records. Round up: 25 records use 3 groups, so Rush costs $120 Media Mail, $180 Priority, or $360 Express. The selected USPS service is included; standard packing/handling still applies. Online orders are limited to 100 records. Production and delivery dates are estimates, not guarantees.

Rush Production — Quality Considerations: Rush orders are manufactured on an accelerated production schedule. Customers acknowledge that shorter production timelines may increase the risk of minor cosmetic imperfections, artwork variations, and production inconsistencies. Rush orders may allow less time for optional revisions or additional inspections. All Rush orders remain subject to our standard manufacturing tolerances and quality requirements. This disclosure does not exclude remedies for verified manufacturing defects or rights protected by applicable law.

28. Required Materials, Delayed Files & Incomplete Orders

Customers should submit all required production audio, artwork, PQ information, and other required materials at checkout or within the period stated in the applicable ordering instructions.

Unless another period is expressly stated, required production audio, artwork, PQ information, and other required production materials must be submitted at checkout or within 24 hours after purchase.

Payment does not reserve production time or production capacity while required customer materials remain outstanding. Production timing begins only after the required usable materials have been received, unless we expressly agree otherwise in writing.

If required materials remain outstanding for 30 days, we may, to the extent permitted by law and considering work already performed, custom materials, or resources already allocated, treat the project as abandoned, unable to fulfill, or requiring a new production arrangement.

After that period, we may close the original production schedule and require a new scheduling or pricing arrangement before proceeding. Any cancellation, refund, credit, or retention of charges will be determined based on the purchased services, work performed, nonrecoverable commitments, our applicable policies, and governing law; payment is not automatically forfeited solely because 30 days have passed.

Delays caused by missing, incomplete, conflicting, unusable, or late customer materials are not production delays attributable to Lathe Cut Vinyl Records.

29. Rights to Audio, Artwork & Submitted Materials

Customers may submit only audio, recordings, compositions, samples, beats, artwork, photographs, logos, trademarks, names, likenesses, designs, text, or other materials that they own, control, or have all necessary rights, licenses, permissions, clearances, and consents to use and reproduce for the products and services ordered.

By submitting materials, the customer represents and warrants that the customer has authority to authorize Lathe Cut Vinyl Records to reproduce, process, master, sequence, manufacture, print, engrave, modify as technically necessary, package, and otherwise use those materials solely as reasonably necessary to perform and fulfill the purchased products and services.

Customers are solely responsible for obtaining any copyright licenses, master-recording rights, composition or mechanical rights, sample clearances, trademark permissions, publicity or likeness permissions, releases, royalty authorizations, or other third-party rights required for the materials they submit.

No Duty to Identify, Research or Verify Submitted Content

Lathe Cut Vinyl Records is a manufacturing and audio-service provider and does not operate as a copyright-clearance, rights-verification, music-identification, or licensing service.

We are not required to recognize, identify, research, investigate, or determine the ownership, artist, performer, songwriter, label, publisher, copyright status, licensing status, or origin of audio, artwork, or other materials submitted by a customer.

We may reasonably rely on the customer's representation and warranty that the customer owns, controls, or has obtained the rights, licenses, permissions, clearances, and consents necessary for the requested reproduction, processing, manufacturing, printing, engraving, and fulfillment.

Our acceptance, review, processing, mastering, sequencing, cutting, printing, engraving, manufacture, or fulfillment of submitted material does not constitute a determination, verification, or representation by Lathe Cut Vinyl Records that the material is lawfully owned, licensed, cleared, or otherwise authorized.

A failure by Lathe Cut Vinyl Records to recognize copyrighted, commercially released, publicly available, or otherwise third-party material does not transfer responsibility for obtaining the necessary rights from the customer to Lathe Cut Vinyl Records.

Submitting publicly available music, a streaming link, YouTube link, social media link, purchased digital file, or other publicly accessible material does not establish reproduction or manufacturing rights.

We may refuse, suspend, or stop work where we actually become aware of information giving us reasonable grounds to believe submitted material may infringe copyright, trademark, publicity, privacy, or other rights or may otherwise be unauthorized or unlawful.

Proof of Authorization. We may request reasonable documentation establishing the customer’s authority to reproduce submitted audio, compositions, samples, artwork, or other protected material before beginning or continuing manufacture, including when a replacement or remake is requested. Documentation may include a written license, authorization from the relevant rights holder, or other reliable evidence appropriate to the rights involved. A customer’s purchase of a recording, streaming subscription, or possession of a digital file does not by itself establish reproduction rights. If requested authorization is not supplied, we may suspend or decline the affected work, subject to applicable law and any remedies otherwise owed for our own verified errors or defects.

To the fullest extent permitted by applicable law, customers are responsible for claims, liabilities, damages, costs, or expenses arising from their unauthorized submission or use of third-party materials.

30. Production Files, Storage & Reorders

Lathe Cut Vinyl Records is not a permanent digital-storage, archival, backup, or cloud-storage provider.

Customers are responsible for maintaining permanent backups of audio, artwork, PQ sheets, metadata, masters, and other production materials.

Production files may be deleted after an order has been completed and transferred to the applicable shipping carrier. We do not guarantee any minimum production-file retention period after fulfillment.

A future reorder may require the customer to resubmit all necessary production files.

We are not obligated to reconstruct an old project, recreate deleted files, reproduce prior processing settings, or maintain a permanent technical archive of every previous order.

Ordinary business records may be retained for accounting, tax, legal, fraud-prevention, dispute, warranty, operational, or other legitimate business purposes as permitted or required by law.

31. Production Records, Quality Control & Evidence

Lathe Cut Vinyl Records does not necessarily create or retain a permanent technical log containing every waveform, measurement, mastering parameter, filter setting, cutting level, groove-pitch adjustment, cue, physical band operation, or operator decision for every product.

We do not routinely photograph, video-record, audio-record, measure, or create forensic documentation of every product before shipment.

Unless expressly purchased or required by law, we have no contractual obligation to create special forensic documentation in anticipation of a possible future complaint or payment dispute.

Internal Production Methods & Working Materials

Customers purchase the completed product or service described in their order. Unless expressly included in the purchased service, the customer's purchase does not include a right to receive or inspect our internal production process, working materials, or technical methods.

Lathe Cut Vinyl Records determines the tools, equipment, software, signal chains, processing methods, settings, and technical workflows used to perform mastering, premastering, sequencing, cutting, restoration, transfer, and other audio or production services.

Unless expressly included in the purchased service, we are not required to disclose or provide specific EQ settings, compression or limiting settings, filters, processing chains, plugin selections or settings, hardware settings, cutting-system settings, presets, templates, calibration information, session files, internal notes, test files, screenshots, or other internal production methods or working materials.

Raw, intermediate, processed, premastering, mastering, cutting, test, reference, or other working audio created or used as part of our internal production process is not a customer deliverable unless that material is expressly included in the purchased service. Customers receive only the physical products, final digital files, masters, or other deliverables expressly included in the product or service purchased.

The use or non-use of any particular piece of hardware, software, plugin, processor, technique, or signal chain is not itself a specification of the purchased service unless expressly agreed in writing before purchase.

The absence or non-disclosure of internal session files, processing settings, intermediate audio, screenshots, equipment settings, mastering parameters, cutting settings, or other internal working materials does not by itself establish that a purchased audio or production service was not performed.

Our internal production methods and working materials remain under our control and are not required to be provided solely in response to a customer request, claim, complaint, chargeback, or payment dispute, except where disclosure is required by applicable law, valid legal process, or another binding obligation.

Claims may be evaluated using reasonably available records, including order information, invoices, submitted or retained files, approvals, correspondence, production records, fulfillment records, shipping records, tracking, delivery information, photographs, returned products, or other available evidence.

The absence of a particular photograph, recording, measurement, waveform, technical log, internal session, processing setting, or other special documentation does not by itself establish that a product was defective, a service was not performed, or a transaction was unauthorized.

32. Shipping, Handling & Delivery

Shipping methods vary according to product eligibility, carrier rules, destination, packaging, contents, quantity, weight, and applicable law.

Qualifying U.S. custom-record orders are normally fulfilled using USPS Media Mail unless another service is purchased or expressly arranged.

Priority Mail, Priority Mail Express, UPS, or another service may be offered through a Rush service, custom invoice, product-specific shipping method, or other arrangement approved by Lathe Cut Vinyl Records.

Different shipping rules may apply to record blanks, diamond styli, cutting supplies, liquids, maintenance products, commercial orders, international orders, gift cards, and specialty products.

Selecting faster shipping does not shorten production time unless a separate Rush production service is also purchased or otherwise expressly agreed.

Carrier delivery estimates are not guaranteed by Lathe Cut Vinyl Records.

Customers are responsible for providing a complete and accurate delivery address.

Returned, refused, undeliverable, or incorrectly addressed packages may require additional shipping or handling charges before reshipment, except where the problem was caused by our error or applicable law requires another remedy.

Separate Shipments

Products may require separate shipments because of size, quantity, packaging, product eligibility, carrier rules, liquids, specialty materials, supplier fulfillment, or another operational requirement.

An original production or shipping charge does not necessarily prepay a later, separate, replacement, additional-component, or reorder shipment unless expressly stated.

Customer-Supplied Shipping Labels

Where expressly approved, a customer may supply an eligible shipping label.

Supplying a shipping label does not automatically remove production, handling, packaging, preparation, or fulfillment charges because those charges are not solely postage charges.

Shipping Insurance

Standard Media Mail production and fulfillment charges do not include separately purchased additional shipping insurance.

Some carrier services may include limited carrier coverage according to the carrier's terms.

Where available, additional shipping insurance may be arranged before shipment at the applicable carrier or insurance-provider cost.

Lathe Cut Vinyl Records is not an insurance company and does not independently underwrite shipping insurance.

International Shipping & Freight Forwarders

International shipping availability varies by product.

Custom-record international shipping is generally not offered unless expressly accepted through a custom arrangement.

International shipping may be available for certain blanks, diamond styli, supplies, commercial orders, or other eligible products.

Liquids and other products subject to transportation restrictions may have more limited international availability.

Customers may use a freight-forwarding service where appropriate and legally permitted.

Customers are responsible for customs requirements, duties, taxes, brokerage, import charges, forwarding charges, and other destination-country fees unless expressly agreed otherwise.

33. Final Sale, Returns, Refunds & Claims

Many products and services sold by Lathe Cut Vinyl Records are custom-made, customer-specific, individually manufactured, specialty materials, consumable professional tools, liquids or maintenance products, or services performed specifically for the customer.

Accordingly, purchases are generally final sale except where otherwise expressly stated or required by applicable law.

We do not generally accept voluntary returns or provide refunds because a customer changes their mind, ordered the wrong option, supplied incorrect files, selected an incompatible product, no longer needs the product, used or altered a consumable or precision product, or dislikes a subjective characteristic of a product that substantially conforms to the order.

Nothing in these Terms eliminates rights or remedies that cannot lawfully be waived.

Claims

A customer who believes a product has a manufacturing defect, arrived materially damaged, or that a service materially failed to conform to the purchased service should contact us within 7 calendar days of delivery or, for a non-physical service, within 7 calendar days after delivery of the completed work.

Customers should provide the order number, description of the issue, and reasonable supporting information requested so the claim can be evaluated.

Contacting us does not itself authorize a return.

Where inspection is reasonably necessary, we may require an authorized return before determining the appropriate remedy.

Authorized Return Shipping and Inspection

Customers must obtain written authorization before returning a product. Unless applicable law requires otherwise or we agree in writing, the customer initially pays the cost of shipping an authorized return to us. USPS Media Mail is our recommended standard return method for eligible records; other products must use an appropriate authorized carrier service. Customers should not expect reimbursement for expedited return postage unless we approve it in writing.

We may examine an affected record under a microscope, inspect its grooves and surface, and playback-test it on properly functioning equipment. A report or video of skipping does not by itself establish the cause of the problem. Microscopic findings can identify damage or irregularities but cannot always establish when or how damage occurred.

If evaluation confirms a manufacturing defect or shipping error attributable to Lathe Cut Vinyl Records, we will provide an appropriate remedy and reimburse reasonable authorized return postage or otherwise cover it as required by law. If replacement is the approved remedy, we will pay for standard shipment of the replacement to the customer.

If no attributable defect or error is established, the customer remains responsible for the initial return postage and the postage to ship the inspected item back, to the extent permitted by law. Any payment for shipment back will be arranged before dispatch. We will not automatically discard or take ownership of an inspected customer product because return postage has not been paid. Further procedures and deadlines are stated in our Returns & Refund Policy.

Customers should preserve the product, packaging, shipping materials, and relevant components reasonably necessary to evaluate a claim.

Continued use, modification, machining, cutting, installation, disassembly, mixing, consumption, or disposal of an allegedly defective product may make the original condition more difficult or impossible to evaluate.

Defect Standard

A manufacturing defect generally means a material failure attributable to Lathe Cut Vinyl Records that causes the finished product or purchased service to substantially fail to conform to the ordered and approved program, applicable specifications, or services purchased.

For custom records, the primary production standard includes whether the approved or submitted musical program is present on the intended side and substantially conforms to the products and services purchased, subject to the physical characteristics and limitations of lathe-cut manufacturing.

Customer source characteristics, customer file or sequencing errors, subjective loudness or tonal preferences, normal record limitations, reasonable cutting adjustments, reasonable dimensional or cosmetic manufacturing variation, expected handmade variation, incompatible equipment, customer misuse, and playback-system differences are not by themselves manufacturing defects.

The presence, absence, width, appearance, or exact location of a visible groove band does not by itself establish a defect where the intended audio program plays and the record otherwise substantially conforms to the purchased product.

The fact that more songs are present than visible physical track sections also does not by itself establish a defect where the program complies with our standard physical track-band rules.

Available Remedies

For a verified issue attributable to Lathe Cut Vinyl Records, an appropriate remedy may include correction, re-performance, repair, replacement of the affected product or component, exchange, store credit, refund, or another remedy depending on the circumstances and applicable law.

For a verified manufacturing defect or error attributable to us, our first remedy is replacement, correction, repair or re-performance of the affected item or service. A monetary refund is offered only if we elect to provide one or applicable law requires it.

Original packaging is required for any authorized return, except where applicable law requires otherwise. We may also require the complete affected project, including all records, sleeves, jackets, labels and supplied components, for inspection and comparison. Our written return authorization will specify what must be returned. A return authorization, receipt or inspection does not itself approve a refund or establish that a defect is our responsibility. Authorized return deadlines and return-shipping procedures in our Returns & Refund Policy continue to apply.

A verified issue affecting one unit, side, program, component, or service does not automatically establish that unaffected portions of the order are defective.

The filing of a complaint, payment dispute, or chargeback does not itself establish that a product was defective or that a refund is owed.

34. Cancellations

Because custom production and services may begin shortly after usable materials and payment are received, cancellation may not be possible once work has begun, materials have been allocated, audio work has been performed, artwork has been prepared or printed, or manufacturing has started.

Where cancellation is accepted, amounts attributable to work already performed, custom materials already used or committed, or nonrecoverable costs may be non-refundable to the extent permitted by law.

35. Payments, Fraud, Chargebacks & Payment Disputes

Customers agree to provide accurate billing, payment, contact, and order information and to use only payment methods they are authorized to use.

We may retain and use ordinary business records reasonably necessary to respond to suspected fraud, unauthorized-payment claims, chargebacks, payment disputes, legal claims, or other transaction disputes.

Such records may include order information, invoices, transaction information, customer correspondence, submitted files or file information where retained, approvals, production information, fulfillment records, shipping information, tracking, and delivery confirmation.

A payment dispute does not modify the products or services originally purchased or create additional specifications that were not part of the original agreement.

Nothing in this section limits a customer's lawful right to dispute a genuinely unauthorized transaction or exercise rights that cannot legally be waived.

36. Customer Equipment, Playback & Compatibility

Playback results can vary based on turntable setup, stylus profile and condition, tracking force, cartridge alignment, anti-skate, tonearm geometry, phono stage, speakers, headphones, amplification, cleanliness, and other equipment or environmental factors.

Differences caused by customer playback equipment or setup do not by themselves establish a manufacturing defect.

Groove Fragility and Customer-Caused Playback Damage

Lathe-cut records have delicate, individually cut grooves that can be permanently damaged by improper handling, playback, cleaning, or storage, including during the first playback. A worn, damaged, contaminated, or improperly adjusted playback stylus may slide or skate across a record, scratching or deforming the grooves and causing skipping, repeating, distortion, or other playback problems during subsequent playback, even if the record was manufactured correctly.

Damage occurring after delivery because of improper tracking force, anti-skate adjustment, cartridge alignment, stylus condition, cleaning, storage, or other customer-controlled conditions is not a manufacturing defect attributable to Lathe Cut Vinyl Records. A visible scratch or a playback complaint alone does not prove whether the issue arose in manufacturing, transit, or later handling.

When reasonably necessary, we may require an authorized return for microscopic groove examination, physical inspection, and playback testing before determining whether a manufacturing defect exists. A single isolated skip does not automatically establish a manufacturing defect, but an isolated skip may qualify when inspection confirms that it resulted from our manufacturing process and materially affects normal playback. Applicable return-shipping procedures and remedies are stated in Section 33 and our Returns & Refund Policy.

Customers purchasing blanks, cutting tools, liquids, maintenance products, or professional supplies are responsible for determining compatibility with their equipment, materials, and processes.

37. Warranties & Limitation of Liability

To the fullest extent permitted by applicable law, products and services are provided subject to the specifications, limitations, tolerances, risks, and characteristics stated in these Terms and applicable product descriptions.

We do not guarantee subjective artistic satisfaction, commercial success, streaming performance, chart performance, resale value, compatibility with every playback, cutting, manufacturing, cleaning, or technical system, or an exact subjective sonic or cosmetic result.

To the fullest extent permitted by law, George W Paulin LLC shall not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from a product or service, including lost profits, lost business, lost opportunities, lost release dates, or other consequential loss, except where such limitation is prohibited by law.

To the fullest extent permitted by law, our aggregate liability arising from a particular affected product or service shall not exceed the amount actually paid to Lathe Cut Vinyl Records for that particular affected product or service.

Nothing in these Terms excludes or limits liability, warranties, remedies, or consumer rights that cannot legally be excluded or limited.

The foregoing limitations are intended to apply only to the extent enforceable under applicable law and do not restrict remedies for a verified manufacturing defect, nonconforming product, or other liability that cannot lawfully be limited. Nothing here requires a customer to waive a legally protected chargeback or consumer complaint right.

38. Website Information, Pricing & Errors

We make reasonable efforts to provide accurate product information, pricing, specifications, availability, photographs, and descriptions.

Typographical errors, technical errors, outdated information, inventory errors, or obvious pricing mistakes may occasionally occur.

Where an obvious material error is discovered before production or shipment, we may contact the customer to correct the order, collect or refund an applicable difference, substitute only with customer agreement where appropriate, or cancel and refund the affected unperformed portion.

39. Force Majeure

Lathe Cut Vinyl Records is not responsible for delay or failure caused by circumstances beyond our reasonable control, including carrier disruptions, weather, natural disasters, utility or internet outages, equipment failure, material shortages, supplier delays, labor disruptions, transportation restrictions, government action, emergencies, or other events beyond our reasonable control.

We will make reasonable efforts to resume affected performance when reasonably possible.

40. Entire Agreement & Order-Specific Communications

These Terms, together with the applicable product page, checkout information, invoice, incorporated policies, production requirements, and applicable order-specific written agreements, constitute the agreement governing the purchase.

FAQ pages, preparation instructions, safety information, and product-specific requirements may supplement these Terms by providing technical or operational requirements for a particular product or service.

A custom quote, email, message, or invoice does not eliminate these Terms unless a specific provision is expressly modified in writing for that order.

An order-specific written agreement regarding a particular specification may control that specific specification without waiving unrelated provisions of these Terms.

41. Severability

If any provision of these Terms is found unenforceable or invalid, that provision shall be enforced to the maximum extent permitted by law or severed as necessary, and the remaining provisions shall continue in effect.

42. Governing Law

These Terms are governed by the laws of the State of Michigan, without regard to conflict-of-law principles, except to the extent applicable law requires otherwise.

43. Customer Indemnification & Enforcement Costs

To the fullest extent permitted by applicable law, the customer agrees to indemnify, defend, and hold harmless George W Paulin LLC, doing business as Lathe Cut Vinyl Records, and its owners, employees, agents, and representatives from third-party claims, demands, damages, liabilities, judgments, settlements, costs, and reasonable attorneys' fees and legal expenses to the extent arising from:

• Audio, artwork, recordings, compositions, trademarks, photographs, or other materials submitted by the customer without the necessary rights, licenses, permissions, or authorizations.
• Alleged infringement of copyright, trademark, intellectual property, privacy, publicity, or other third-party rights resulting from customer-submitted materials.
• The customer's material breach of these Terms of Service or applicable law in connection with products or services purchased.
• The customer's fraudulent, unlawful, or materially misleading submissions, representations, or instructions.

This obligation applies only to the extent a third-party claim arises from the customer's conduct, breach, or submitted materials. It does not require a customer to indemnify Lathe Cut Vinyl Records for claims to the extent caused by our own negligence, misconduct, breach of contract, independently unlawful acts, or other liability that cannot lawfully be shifted to the customer.

We will provide reasonable notice of a claim for which indemnification is sought and a reasonable opportunity for the customer to participate in its defense, subject to applicable law. No settlement imposing a nonmonetary obligation or admission on the other party may be made on that party's behalf without its consent. Any obligation to defend or pay legal expenses remains subject to applicable law and the circumstances of the claim.

Enforcement Costs & Attorneys' Fees

To the fullest extent permitted by applicable law, if Lathe Cut Vinyl Records substantially prevails in a legal proceeding to enforce these Terms against a customer for a material breach of contract, Lathe Cut Vinyl Records may recover its reasonable attorneys' fees and court costs attributable to that enforcement, as determined by a court of competent jurisdiction.

This provision does not apply solely because a customer submits a complaint, requests a lawful remedy, or exercises a statutory consumer right. It does not require a customer to reimburse legal expenses arising from our own breach, negligence, misconduct, or unlawful acts, and does not limit rights that cannot legally be waived.

44. Jurisdiction & Venue

Subject to applicable law and non-waivable consumer rights, the parties agree that a lawsuit arising from or relating to these Terms, an order, or products or services purchased shall be brought in a court of competent jurisdiction located in Kent County, Michigan, or, where federal subject-matter jurisdiction exists, the United States District Court for the Western District of Michigan.

Each party consents to the personal jurisdiction of those courts to the extent permitted by applicable law. Nothing in this section prevents a consumer from bringing a claim in another forum when applicable law prohibits enforcement of this venue restriction or grants a non-waivable right to another forum.

45. Mutual Waiver of Jury Trial

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, GEORGE W PAULIN LLC AND THE CUSTOMER EACH KNOWINGLY AND VOLUNTARILY WAIVE THE RIGHT TO A TRIAL BY JURY IN ANY CIVIL ACTION ARISING FROM OR RELATING TO THESE TERMS, AN ORDER, OR THE PRODUCTS OR SERVICES PURCHASED.

Where this waiver is valid and enforceable, such claims will be decided by a judge rather than a jury. This section does not waive any right that cannot lawfully be waived.

46. Individual Proceedings & Class-Action Waiver

To the fullest extent permitted by applicable law, the parties agree to pursue covered disputes in their individual capacities and not as a plaintiff, claimant, or class member in a class, collective, or representative proceeding. Neither party consents to consolidation of separate individuals' claims into a class or representative proceeding except where required by law or agreed by the parties.

This provision does not restrict claims or procedures for which an individual-proceedings waiver is prohibited by applicable law. If this provision is unenforceable as to a particular claim or proceeding, the remaining provisions of these Terms shall remain effective to the extent permitted by law.

47. Changes to These Terms

We may update these Terms from time to time.

The version applicable to a transaction is generally the version in effect when the applicable order is placed, except where the parties expressly agree otherwise or applicable law requires another result.

The “Last Updated” date identifies the current published version.

48. Right to Refuse Service, Content Standards & Customer Conduct

Lathe Cut Vinyl Records, operated by George W Paulin LLC, reserves the right, to the fullest extent permitted by applicable law, to refuse, decline, suspend, or discontinue an order, project, custom manufacturing request, or professional service for legitimate business, operational, safety, legal, ethical, or content-related reasons.

We are not obligated to manufacture, reproduce, master, print, engrave, or otherwise participate in projects containing material that we reasonably determine promotes, celebrates, or encourages racism, antisemitism, racial supremacy, homophobia, transphobia, sexism, discrimination, hate speech, targeted harassment, bullying, threats, intimidation, violence, sexual exploitation, abuse, or unlawful conduct.

We may also decline projects containing excessive profanity, explicit sexual content, graphic violence, or other material inconsistent with our business content standards. Profanity or controversial subject matter does not automatically require us to decline a project.

Content decisions concern the material or service requested, not a customer's protected personal characteristics. We do not refuse service because of race, religion, sex, sexual orientation, gender identity, disability, or another characteristic protected by applicable law.

We may decline future business or discontinue nonessential communications with customers who engage in threats, harassment, abusive language directed at staff, repeated personal attacks, fraud, or persistent conduct that materially interferes with business operations.

We are not obligated to debate or negotiate our discretionary content standards or engage in repeated correspondence after communicating a final business decision. We may limit communications to those reasonably necessary to resolve an existing transaction, fulfill legal obligations, or address an outstanding claim.

If we decline or cancel a paid order before production because of our content standards, we will refund the unperformed portion as required by applicable law. If work has begun, any charges retained must be lawful and consistent with work performed, applicable policies, and the circumstances of cancellation.

Nothing in this section permits unlawful discrimination or retaliation or denies refunds, remedies, or other rights protected by applicable law.
